The Subdivision and Condominium Buyers’ Protective Decree is the law that regulates the sale of subdivision lots and condominium units in the Philippines.

The Subdivision and Condominium Buyers’ Protective Decree was enacted in 1976 as Presidential Decree No. 957. It aims to protect buyers from fraudulent or unscrupulous practices by developers, brokers, or sellers of subdivision and condominium projects.

The Subdivision and Condominium Buyers’ Protective Decree provides for the following:

  • The registration and licensing of subdivision and condominium projects by the Housing and Land Use Regulatory Board (HLURB)
  • The standards and specifications for the development, improvement, and maintenance of subdivision and condominium projects
  • The rights and obligations of buyers, such as the right to inspect the project, to receive a contract to sell, to pay in installments, to be refunded in case of cancellation or default, and to form a homeowners association
  • The rights and obligations of developers, such as the right to collect payments, to enforce liens, to transfer or assign rights, and to advertise or sell the project
  • The penalties for violations of the Subdivision and Condominium Buyers’ Protective Decree or its implementing rules and regulations
The Subdivision and Condominium Buyers’ Protective Decree has been amended by Presidential Decree No. 1216, which defines open spaces in residential subdivisions and amends section 31 of Presidential Decree No. 957.
